Acceptable Use Policy

1. Acceptance of this Policy

By accessing or using any AblePage website, product, or service, you agree to comply with this Acceptable Use Policy ("AUP"), our Terms of Service ("TOS"), and our Privacy Policy. Together, these documents are referred to as the "Agreement".

Throughout this AUP, "AblePage", "we", "us", and "our" refer to AblePage and its employees or representatives. "You", "your", and "Customer" refer to the individual or organization using our Services. "Services" refers to the AblePage website and any hosting, domain, email, or other products and services provided by AblePage.

Our Services may rely on third-party datacenters, networks, infrastructure providers, and other upstream service providers. Your use of our Services must also comply with any applicable restrictions imposed on AblePage by these providers.

Your continued use of our Services constitutes your acceptance of the Agreement. If you do not agree with these terms, you must discontinue your use of the Services.

AblePage reserves the right to restrict, suspend, or terminate Services that are used in violation of this AUP, our Terms of Service, applicable law, or applicable upstream provider requirements.

2. General Prohibitions

You may not use AblePage's Services for any unlawful, abusive, fraudulent, or irresponsible purpose or in any way that could damage, disable, disrupt, overburden, or impair our servers, network, infrastructure, or Services.

You may not use the Services in a manner that materially interferes with another customer's use of AblePage's Services or negatively affects the stability, security, reputation, or operation of AblePage or its upstream providers.

You are responsible for all activity originating from your account, websites, applications, email accounts, and other Services under your control.

3. Illegal or Harmful Use

You may not use AblePage's Services to host, publish, distribute, transmit, promote, or otherwise make available material or activities that:

• Violate applicable local, state, national, or international law;
• Are fraudulent, deceptive, or unlawful under applicable consumer protection laws;
• Infringe the copyright, trademark, patent, trade secret, or other intellectual property rights of another person or organization;
• Improperly disclose confidential, proprietary, private, or personal information belonging to another person or organization;
• Are defamatory or unlawfully harm the reputation of another person or organization;
• Violate or infringe another person's right to privacy;
• Involve doxxing or the unauthorized disclosure of personal information where doing so violates applicable law or creates a credible risk of harm;
• Are intended to circumvent copyright protection, access controls, or other technical protection measures;
• Create an unlawful risk to the safety or health of another person or the public;
• Unlawfully interfere with an investigation by law enforcement or another government authority;
• Promote or facilitate illegal drugs, illegal gambling, unlawful weapons trafficking, or other unlawful commerce;
• Violate applicable export control or sanctions laws;
• Contain or facilitate malware, phishing, credential theft, fraud, or other malicious activity; or
• Are otherwise likely to expose AblePage, its customers, or its upstream providers to legal liability, network abuse, security threats, or retaliatory activity.

AblePage may restrict or suspend Services where we reasonably believe continued operation presents a material legal, security, network, or abuse risk.

4. Defamation and Privacy

You may not use AblePage's Services to host, publish, distribute, transmit, or otherwise make available content that:

• Is defamatory or unlawfully harms the reputation of another person or organization;
• Violates or infringes another person's right to privacy;
• Unlawfully publishes, distributes, or exposes another person's private or personal information;
• Involves doxxing or the unauthorized disclosure of personal information where doing so violates applicable law or creates a credible risk of harm; or
• Otherwise violates applicable laws relating to defamation, privacy, confidentiality, or the protection of personal information.

AblePage reserves the right to investigate complaints regarding alleged defamatory content or privacy violations and, where appropriate, may restrict access to content or take other action in accordance with this AUP and applicable law.

Complaints should identify the specific content and URL or URLs involved and provide sufficient information for AblePage to investigate the matter.

5. Email and Spam

Unsolicited Email

You may not use our Services to send unsolicited commercial email, bulk email, or other messages to recipients who have not affirmatively consented to receive them.

You must honor unsubscribe and opt-out requests promptly and comply with applicable anti-spam laws, including the CAN-SPAM Act where applicable.

The use of purchased, harvested, scraped, generated, or otherwise improperly obtained mailing lists is prohibited.

Bulk Commercial Email

Bulk commercial email may only be sent through AblePage's Services with prior approval from AblePage where such approval is required.

Where bulk mailing is permitted, you must be able to demonstrate that recipients affirmatively opted in to receive the messages, maintain reasonable records of consent, provide a clear method of withdrawing consent, process opt-out requests promptly, and maintain accurate sender information.

AblePage may request evidence of recipient consent at any time. Approval from AblePage does not override restrictions imposed by an upstream network or infrastructure provider.

Spamvertising

You may not use another network or third-party email provider to send unsolicited messages that advertise, promote, link to, or otherwise direct recipients to a website or service hosted by AblePage.

Email and Network Reputation

Email must be sent in a manner that does not negatively affect AblePage, its IP reputation, its upstream providers, or other customers. If your email activity results in excessive complaints, blocklisting, reputation damage, or other material network issues, AblePage may restrict or suspend email functionality or the affected account.

6. Copyright and DMCA

You may not use our Services to infringe the copyrights of another person or organization. This includes knowingly hosting, distributing, reproducing, or providing unauthorized access to copyrighted material, or operating a service primarily intended to facilitate copyright infringement.

AblePage will respond to valid copyright infringement notices as required by applicable law, including valid notices submitted under the Digital Millennium Copyright Act ("DMCA").

Repeated or serious copyright infringement may result in suspension or termination of Services.

7. Trademark and Intellectual Property Infringement

You may not use our Services to infringe the trademark, patent, trade secret, or other intellectual property rights of another person or organization.

This may include unauthorized use of trademarks, logos, or branding, as well as the sale or distribution of counterfeit or otherwise unauthorized goods.

8. Illegal and Prohibited Content

You may not use our Services to host, distribute, advertise, promote, or provide access to content prohibited by applicable law.

• Child sexual abuse material or content involving the sexual exploitation of minors;
• Fraudulent or deceptive schemes;
• Illegal gambling operations;
• Illegal drug trafficking;
• Unlawful weapons trafficking;
• Content that unlawfully exposes confidential or proprietary information;
• Content that unlawfully violates another person's privacy;
• Malware, phishing pages, credential theft, or other malicious content; and
• Other material whose possession, publication, distribution, or promotion is prohibited by applicable law.

9. Adult Content

Adult content is prohibited on AblePage's Services.

You may not use our Services to host, publish, distribute, transmit, advertise, promote, or link to pornography, sexually explicit material, adult entertainment, or other content primarily intended for sexual or erotic purposes. This prohibition applies regardless of whether such content is otherwise legal in the jurisdiction in which it is produced, hosted, or accessed.

AblePage reserves the right to remove prohibited adult content and restrict, suspend, or terminate Services used to host or distribute such content.

10. IRC and Similar Networks

IRC servers, IRC bots, IRC networks, and similar services are prohibited on AblePage's network.

AblePage may also restrict other persistent chat or network services where required by an upstream provider or where the activity presents an unreasonable security, abuse, or network stability risk.

11. Security and Account Responsibility

You are responsible for maintaining the security of your websites, applications, accounts, passwords, and other Services.

You must take reasonable precautions to prevent unauthorized access to or use of your account, including keeping passwords and other authentication credentials confidential.

If you become aware that an account, website, application, or credential has been compromised, you are responsible for taking reasonable steps to secure it.

AblePage may temporarily restrict, isolate, disable, or suspend a compromised account or Service where necessary to protect our infrastructure, upstream providers, other customers, or third parties.

12. Network Abuse and Unauthorized Access

You may not use our Services to engage in unauthorized access, network abuse, or security attacks. Prohibited activities include, but are not limited to:

• Accessing or attempting to access systems, accounts, networks, or data without authorization;
• Probing, scanning, or testing the vulnerability of a system or network without authorization;
• Port scanning or security scanning systems you do not have permission to test;
• Monitoring network traffic or data without authorization;
• Password cracking, credential theft, phishing, or other attempts to obtain authentication credentials;
• Mail bombing, flooding, denial-of-service attacks, distributed denial-of-service attacks, or deliberate attempts to overload a system;
• Broadcast attacks;
• Forging or manipulating TCP/IP packet headers;
• Forging email or newsgroup headers for deceptive or abusive purposes;
• Distributing malware or malicious scripts;
• Operating botnets or command-and-control infrastructure;
• Using another person's Internet account, system, or computing resources without authorization; or
• Any activity intended to interfere with the normal operation of another system, service, user, host, or network.

Authorized security testing of systems you own or have explicit permission to test is permitted provided that the activity does not negatively affect AblePage's network, upstream providers, or other customers.

13. Server and Network Stability

AblePage's infrastructure is designed to provide Services to multiple customers. You may not use the Services in a way that materially threatens the stability, security, performance, or availability of our infrastructure or another customer's Services.

This includes activities that cause or contribute to excessive CPU, memory, disk, database, or network utilization; network flooding or excessive connections; service degradation affecting other customers; IP address or network blocklisting; denial-of-service attacks or retaliation directed toward AblePage or its upstream providers; or other abnormal resource consumption that threatens the stability of shared infrastructure.

If we determine that your account is causing or is likely to cause significant disruption, AblePage may temporarily restrict or suspend the affected Services while the issue is investigated and resolved. This may apply even where the underlying activity itself is otherwise lawful.

14. Excessive or Network-Unfriendly Activity

You may not use AblePage's Services in a manner that consumes unreasonable resources or materially affects the performance of our servers, network, or other customers.

Depending on the Service purchased, restricted activities may include:

• Public web proxies or similar proxy services;
• File-sharing services where the primary purpose is bulk file storage or distribution;
• Video or image hosting services primarily intended for bulk third-party distribution;
• BitTorrent clients, trackers, or similar peer-to-peer applications;
• Game servers;
• Cryptocurrency mining;
• Public crawlers, spiders, or indexing applications that consume excessive resources;
• Applications or processes that continuously consume unreasonable server resources; and
• Using a standard hosting account primarily as a remote backup or general-purpose file storage service.

Files stored within a standard hosting account should generally relate to the websites, applications, email, or other Services hosted within that account. Automated tasks and cron jobs must be configured responsibly and must not create excessive server load.

Resource limits may vary depending on the hosting plan or Service purchased. Any specific resource limits published for a Service form part of this AUP.

15. Third-Party Networks and Services

When using AblePage's Services to access, interact with, or participate in another network, service, forum, newsgroup, or online platform, you must comply with the applicable rules of that network or service.

You may not use AblePage's Services in a manner that causes another provider or network operator to take technical or administrative action against AblePage or its upstream providers.

Activities that result in repeated abuse complaints, network blocks, IP blocklisting, denial-of-service attacks, or other retaliatory action may result in restriction or suspension of Services.

16. Resale of Services

Unless your hosting plan specifically permits resale, you may not resell, sublicense, or provide portions of your AblePage hosting account to unrelated third parties as a hosting service.

Standard shared hosting accounts are intended for use by the account holder and for websites or projects under their control.

Where AblePage offers a service specifically intended for resale, customers wishing to provide hosting services to third parties must use an eligible reseller service or obtain prior written authorization from AblePage.

17. Accurate Account Information

You are responsible for providing AblePage with accurate and current account and contact information.

You must keep your contact details up to date so that AblePage can contact you regarding billing, security, abuse reports, service interruptions, or other important matters relating to your account.

Providing false, misleading, or materially incomplete information may result in additional verification requirements, restrictions, suspension, or termination of your account.

18. Cooperation with Law Enforcement

AblePage may comply with valid and legally binding requests from law enforcement agencies, courts, regulators, and other government authorities.

Where legally permitted and reasonably practical, we may notify affected customers of such requests. However, applicable law, court orders, or other legal requirements may prohibit us from providing notice.

Information may be disclosed only as permitted or required by applicable law and in accordance with our Privacy Policy.

19. Upstream Provider Requirements

Some AblePage Services rely on infrastructure, connectivity, software, or other resources supplied by third-party providers.

Customers must not use AblePage's Services in a manner that causes AblePage to violate the acceptable use policies or other applicable requirements of an upstream provider.

Where an upstream provider requires AblePage to suspend, restrict, disconnect, or otherwise take action against a Service because of Customer activity, AblePage may take the action reasonably necessary to comply with that requirement.

Where practical, AblePage will attempt to provide notice and an opportunity to resolve the issue. Immediate action may be taken where required by an upstream provider or where necessary to address illegal activity, security threats, network attacks, abuse, or significant service disruption.

AblePage may modify or impose additional restrictions on a Service where reasonably necessary to comply with changes to upstream provider requirements.

20. Costs Resulting from Abuse

You are responsible for costs, penalties, administrative charges, remediation expenses, or other fees reasonably incurred by AblePage as a direct result of your violation of this AUP, where permitted by applicable law.

This may include charges assessed against AblePage by a datacenter, network operator, IP provider, software provider, or other upstream provider as a direct result of activity originating from your account.

AblePage will not impose an upstream provider's charge on a Customer unless the charge relates to the Customer's use of the Services or violation of this AUP.

21. Enforcement

AblePage reserves the right to investigate suspected violations of this AUP.

Depending on the nature and severity of a violation, AblePage may issue a warning, request corrective action, restrict specific functionality, block network traffic, disable access to specific content, temporarily suspend Services, or terminate an account or Service.

Where practical, we will provide an opportunity to resolve a violation before terminating Services. However, AblePage may take immediate action where reasonably necessary to protect our customers, infrastructure, upstream providers, third parties, or AblePage from illegal activity, security threats, network attacks, significant service disruption, or other serious risks.

AblePage may also take immediate action where required to do so by a datacenter, network provider, court, law enforcement agency, or other entity with lawful authority over the affected infrastructure or Services.

22. Changes to this Acceptable Use Policy

AblePage may update this Acceptable Use Policy from time to time to reflect changes to our Services, legal requirements, security practices, operational requirements, or requirements imposed by our upstream providers.

The current version of this AUP will be made available on our website. Your continued use of the Services after an updated AUP becomes effective constitutes acceptance of the updated policy.
